Texas Drivers and Legal Obligations When Involved in an Accident

Did you know, as a Texas driver, you have certain legal obligations when you are the driver and cause an accident? Read through this and be prepared, so you don't find yourself in more trouble than you counted on. Also, note that the law does not distinguish between drivers who caused an accident and those who are simply involved in an accident. A driver is a driver.

If you are involved an accident that involves injury or death, you must immediately stop at the scene or as close as possible, return to the scene if you're not already stopped there, determine whether anyone involved requires aid, and remain at the scene until you comply with the Texas law. This includes all involved parties providing their name, address, vehicle registration number, and motor vehicle liability insurer's name to all other involved parties. Additionally, you must provide reasonable assistance to any injured person, such as arranging transportation to a hospital if necessary or requested, and in cases involving serious injury or death, a driver must notify the appropriate law enforcement agency as quickly as possible.
If the accident results only in vehicle damage, then you must stop at the scene, return if necessary, and remain until you provide the required information (name, address, vehicle registration number, and motor vehicle liability insurer's name) to the other party. If the collision caused damage to an unattended vehicle, then you must either locate the owner or leave a written notice with their contact information and details of the incident, and then must later provide the required information (name, address, vehicle registration number, and motor vehicle liability insurer's name).
If the collision occurs on a freeway and the vehicles can be safely driven, the vehicles should be moved to a suitable location to minimize traffic disruption.
If you are driving and are involved in an accident that causes damage to structures, fixtures, or landscaping, you must notify the property owner or person in charge and provide your required information (name, address, vehicle registration number, and motor vehicle liability insurer's name).
Penalties for drivers not abiding by these laws can result in penalties, including criminal penalties. Be responsible, stay safe, and take care of others when you are involved in a collision.
